TERMS AND CONDITIONS OF SALE
1. Scope of application
The general terms and conditions of sale detailed below (hereinafter referred to as the “Terms and Conditions”), govern the contractual relationship between any user of the photosquaresoftheworld.com website (hereinafter referred to as a “User” or “You”) and PHOTOSQUARES OF THE WORLD, whose head office is located at 12 rue de Mirbel 75005 Paris, France.
PHOTOSQUARES OF THE WORLD reserves the right to modify these terms and conditions at any time. It is your responsibility to regularly review the applicable terms and conditions.
Please read the terms and conditions carefully and accept them by clicking on the “accept” icon at the bottom of the account creation form. If you do not wish to accept these terms and conditions, please do not click on the “accept” button. In this case, the service will not be provided. In any event, validation of the order summary by you implies unreserved acceptance of the current terms and conditions, full knowledge of them and waiver of any other conditions.
2. Product presentation
PHOTOSQUARES OF THE WORLD is an online gallery offering limited edition, numbered art photographs called Photosquares for sale. The photographs are offered in one or more formats. Photographs are accompanied by a certificate of authenticity.
3. Product prices
The applicable prices are those displayed on the photosquaresoftheworld.com website, at the time of the order summary and included in the order confirmation sent to you by PHOTOSQUARES OF THE WORLD. No modification will be applied to orders in process. Prices are quoted in euros. In accordance with article 293 B of the French General Tax Code, VAT is not applicable. The prices mentioned in the order summary and in the order confirmation constitute the final prices and charges. Prices and delivery charges are payable online at the time of ordering.
4. Order
To place an order with Photosquares, you must be of legal age. You must at least go through the following steps:
- Consultation of the file presenting a photograph. You can choose the format among those proposed. Stock status is indicated. Click on “Add to cart” to add this item to your shopping cart.
- Basket” screen: you can delete an item or modify the quantities ordered.
- Identification or customer account creation screens. When you create an account, you are identified by an identifier (e-mail) and a password that you create yourself.
- You must provide true, accurate, up-to-date and complete information about yourself as requested in the registration form, in particular as regards your identity, the identity of the recipient of the order and the delivery address, as well as the e-mail address where an order confirmation can be sent. PHOTOSQUARES OF THE WORLD will confirm the acceptance of your order to the e-mail address you have provided. No order is binding on PHOTOSQUARES OF THE WORLD until it has been confirmed by e-mail.
The information you provide when placing an order is binding: in the event of an error in the recipient’s contact details, PHOTOSQUARES OF THE WORLD cannot be held responsible for the impossibility of delivering the order. In particular, the costs of a new delivery of an order following an incomplete or erroneous address, the absence of the recipient, the absence or misidentification of a mailbox will be at your expense.
PHOTOSQUARES OF THE WORLD reserves the right to cancel your order if there is a dispute concerning the payment of a previous order.
- Delivery method screen. On this screen you will find a link to modify the items in your order.
- Summary screen and payment options. This screen allows you to choose your payment method and check the various elements making up your order (items, quantity, delivery method, total price). You must ensure that all these elements comply with your request.
- You must then accept the present terms and conditions of sale and use of the Site to proceed to the payment stage. The terms and conditions are available from the link entitled “General terms and conditions of sale”. You can accept them by checking the box next to the link to these conditions. The general conditions of sale and use of the Site must be accepted for each order.
You pay for your order using the chosen method of payment.
- The contract is concluded when the bank confirms payment.
- The Site will send you a confirmation of your order by e-mail within a few minutes.
5. Payment methods and data security
When you pay for an order on photosquaresoftheworld.com, you enter your bank details directly on the secure Woocommerce server. Your bank details are encrypted (SSL technology). They do not circulate unencrypted on the Internet and cannot be intercepted. PHOTOSQUARES OF THE WORLD has no knowledge of your credit card information.
The personal information you entrust to PHOTOSQUARES OF THE WORLD is stored on the secure servers of our hosting company OVH (except bank details). Access to this information is protected and limited to the registration and processing of your orders, statistical operations allowing us to improve our services such as newsletters, photo alerts, recommendations.
6. Delivery times
The variable lead times for the production and delivery of prints mentioned on the site and/or in the order confirmation are given as an indication.
In any case, PHOTOSQUARES OF THE WORLD undertakes to produce and deliver Photosquares within a maximum period of 60 working days starting from the day following the confirmation of the order by e-mail.
In application of article L121-20-3 of the French Consumer Code, the consumer may obtain, except in cases of force majeure, a refund of the sums paid for the order under the conditions of articles L114-1 and L 121-20-1 of the same code.
7. Delivery and receipt of Photosquares
PHOTOSQUARES OF THE WORLD delivers to Metropolitan France, European Union countries and the rest of the world. The Photosquares ordered will be delivered to the delivery address indicated in the order. When your order is finalized, i.e. when it is ready for delivery, you will receive an information e-mail. In the absence of the addressee or of a person able to take possession of the Photosquares at the time of delivery by the postal services or by a carrier, the postal services or the third party will leave a calling card inviting you to collect the prints at the delivery address you have indicated. Delivery will be considered to have taken place upon the first presentation of the shipment at the delivery address indicated in the order. PHOTOSQUARES OF THE WORLD cannot be held responsible for late collection of Photosquares from the post office or carrier. The customer has a period of 4 months after having been notified of the availability of his order to proceed with its collection. Failing this, the order will be cancelled and any sums previously paid will be retained by the supplier as compensation. Once this period has elapsed, the customer may not claim either a refund or a return of the goods.
If, on receipt of the order, you discover that it has been damaged in transit, you may refuse delivery, stating the reasons for your refusal, or if you accept it, note your remarks on the delivery note.
You must send your complaint to PHOTOSQUARES OF THE WORLD, by e-mail to contact@photosquaresoftheworld.com within 3 working days following the delivery date and if necessary, if the Photosquares need to be returned, they must be sent within 10 working days following the delivery date in their original packaging and at your expense to the following address: Photosquares, 12 rue de Mirbel, 75005 PARIS, FRANCE.
Receipt of transported goods extinguishes any action against the carrier for damage or partial loss if, within three days, not including public holidays, following receipt, the consignee has not notified the carrier, by extrajudicial act or by registered letter, of his reasoned protest (art L 133.3 of the French Commercial Code).
8. Warranty and quality
PHOTOSQUARES OF THE WORLD undertakes to supply you with a Photosquare in compliance with the rules of the art and according to the specifications of your order confirmed by e-mail.
However, upon delivery, if you consider that the Photosquare does not correspond to the characteristics (dimensions, printing) that you chose when confirming your order, you must send us a complaint of non-conformity. You may be asked to return the Photosquare.
After examination by PHOTOSQUARES OF THE WORLD, the print may be removed and reshipped at PHOTOSQUARES OF THE WORLD’s expense or reimbursed in the form of a credit note or by any other means of payment determined by PHOTOSQUARES OF THE WORLD.
However, in the event that PHOTOSQUARES OF THE WORLD does not validate your claim, your initial order will be returned to you.
You will be responsible for the return shipping costs, but you may be reimbursed by PHOTOSQUARES OF THE WORLD if the return is due either to an error on the part of PHOTOSQUARES OF THE WORLD in the fulfillment of the order, or to the delivery of a defective product.
All claims must be made electronically to contact@photosquaresoftheworld.com within 15 calendar days of delivery, specifying the order number and the reason for dissatisfaction.
PHOTOSQUARES OF THE WORLD will not take into account any claim of non-conformity that is not made in accordance with the rules defined above and within the allotted time.
9. Right of withdrawal
In accordance with the French Consumer Code, you have 14 days to exercise your right of withdrawal without giving reasons. If you exercise your right of withdrawal, you will be responsible for the cost of returning the Photosquares. When the fourteen-day period expires on a Saturday, Sunday or public holiday, it is extended to the next working day.
By way of derogation, article L.121-20-2 of the French Consumer Code stipulates that the right of withdrawal may not be exercised unless the parties have agreed otherwise, in particular for contracts for the supply of goods made to the consumer’s specifications or clearly personalized or which, due to their nature, cannot be returned. With regard to your order, you acknowledge that you do not have the right of withdrawal.
10. Rights and personal data
Personal data
In accordance with the French Data Protection Act of January 6, 1978 (Law No. 78-17), you have the right to consult, modify and delete any data brought to PHOTOSQUARES OF THE WORLD’s attention when using the service. 11. Intellectual property rights
Rights to the work
The artist, for having taken the initiative of his creation, remains the owner of the copyright on his creation, within the meaning of French law. The rights of representation and reproduction of the works presented on the photosquaresoftheworld.com site therefore belong to the author, Johanna Pernot. Her authorization is required for any use of these rights. Your rights to the work purchased are therefore limited to private use, excluding all rights of representation and reproduction.
Intellectual property rights
All elements on the site and the site itself are protected by copyright, trademark, design rights and/or other intellectual property rights. By elements, we mean but are not limited to: photographs, images, illustrations, texts, logos, trademarks, models… These elements belong to PHOTOSQUARES OF THE WORLD or are used with the agreement of their owners. As such, any reproduction, representation, use, adaptation, modification, incorporation, translation, commercialization, in part or in full, by any process and on any medium whatsoever (paper, digital…) is forbidden, without the prior written authorization of PHOTOSQUARES OF THE WORLD, with the exception of the exceptions stipulated in article L 122. 5 of the French Intellectual Property Code, under penalty of constituting an infringement of copyright and/or designs and/or trademarks, punishable by two years’ imprisonment and a fine of €152,449.02.
